Terms of Service

Please read these Terms of Service carefully. By accessing easyemailverification.com or using the Easy Email Verification services, you accept these Terms. Please also read our Privacy Policy and our Data Protection page to learn how we collect, use and protect information.

These Terms of Service (the “Terms”) govern the relationship between EASY EMAIL VERIFICATION LTDA, a limited liability company registered in Brazil under CNPJ 60.422.884/0001-02, with its registered office at Av. Almirante Tamandaré, 94, Sala 610 – Coqueiros, Florianópolis – SC, 88080-160, Brazil (“Easy Email Verification”, “we” or “us”), and you, when you access easyemailverification.com and its related domains (the “Site”) and use the email verification and email deliverability services offered through the Site, the dashboard, the API and the integrations (together, the “Services”).

If you accept these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and “you” refers to that entity.

1. The Services

The Services allow you to verify email addresses individually, in bulk or through the API, and to use other email deliverability tools described on the Site. Some features are available on a free plan, subject to the limits described on the pricing page; other features require a paid plan or credits.

Email verification depends on the behavior of third-party mail servers. Some servers do not disclose whether a mailbox exists, block verification temporarily or are unavailable; in these cases the result may be returned as “unknown”. A verification result reflects the information available at the moment of the check and is not a guarantee that a future message will be delivered.

2. Account and API keys

An account is required to use the Services beyond the public areas of the Site. You must provide accurate and up-to-date registration information and be legally capable of entering into these Terms under Brazilian law.

You are responsible for keeping your password and API keys confidential and for all activity carried out through your account or with your API keys. Anyone who has your API key can use your verification credits. Notify us immediately at support@easyemailverification.com if you suspect unauthorized use.

3. Acceptable use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

• use the Services to send, facilitate or prepare unsolicited or unlawful communications;
• submit email addresses or other data that you are not legally allowed to process;
• resell, sublicense or provide the Services to third parties without our prior written authorization;
• decompile, reverse engineer or attempt to obtain the source code of the Services, except where permitted by law;
• circumvent usage limits, quotas, rate limits or security measures, or interfere with the operation of the Services;
• use the Services in violation of the rights of third parties or of applicable law, including Law No. 12,965/2014 (Marco Civil da Internet) and Law No. 13,709/2018 (Lei Geral de Proteção de Dados – LGPD).

4. Your content and personal data

“Your Content” means the email addresses, files and other information you submit to the Services. You are responsible for the legality of Your Content and for having a valid legal basis under the LGPD (and, where applicable, other data protection laws) to process the personal data it contains.

With respect to personal data contained in Your Content, you act as the controller (controlador) and Easy Email Verification acts as the processor (operador), processing such data only to provide the Services to you.

Regarding retention:

• email addresses verified one at a time, in the online email checker or through the API, are not retained after the verification is processed;
• results of bulk list verification are kept for 30 days so you can download them, and are then permanently deleted;
• account data (such as name, email address and credentials) is kept while your account is active, and afterwards as required by law;
• access logs are kept as required by article 15 of Law No. 12,965/2014 (Marco Civil da Internet).

We adopt technical and administrative measures intended to protect personal data against unauthorized access and accidental or unlawful destruction, loss, alteration or disclosure. We may produce statistics about the use of the Services only in anonymized, aggregated form that does not allow the identification of you or of any data subject.

5. Fees and payment

Paid plans and credits are offered at the prices shown on the pricing page at the time of purchase. Pay-as-you-go credits do not expire. Subscriptions are billed in advance for each billing period and may be cancelled at any time; the cancellation takes effect at the end of the current billing period.

Payments are processed by third-party payment providers. We do not store your full payment card data. We may change our prices with at least thirty (30) days’ notice; changes do not affect amounts already paid. Taxes are applied in accordance with applicable Brazilian legislation. Late payments are subject to the charges permitted by applicable law.

If you are a consumer under Law No. 8,078/1990 (Código de Defesa do Consumidor), you may withdraw from a purchase made online within seven (7) days of the contract, under article 49 of that law, and receive a refund of the amounts paid. 6. Availability

We use commercially reasonable efforts to keep the Services available, except during scheduled or emergency maintenance, failures of third-party services and events of unforeseeable circumstances or force majeure (caso fortuito ou força maior), under article 393 of the Brazilian Civil Code. We may improve or modify the Services and will give advance notice of changes that significantly and adversely affect how you use them.

7. Intellectual property

The Services, the Site and their content, software, trademarks and layout are owned by Easy Email Verification or its licensors and are protected by law. These Terms grant you a personal, non-exclusive, non-transferable and revocable right to use the Services while your account is active and in accordance with these Terms; no other right is granted.

If you send us suggestions or feedback, you grant us a free, non-exclusive, perpetual license to use them to improve the Services, without prejudice to the moral rights guaranteed by Law No. 9,610/1998.

8. Third-party services and integrations

The Services may be used together with third-party platforms, such as CRMs, marketing tools and automation services (for example, Zapier). The use of those platforms is governed by their own terms and policies, and we are not responsible for their content or operation.

9. Warranties and limitation of liability

Except as expressly stated in these Terms and to the extent permitted by law, the Services are provided “as is” and “as available”. We do not guarantee that the Services will be uninterrupted or error-free, nor that a verified address will receive future messages.

To the extent permitted by law, Easy Email Verification is not liable for indirect damages, lost profits or loss of business, and its total liability under these Terms is limited to the amounts you paid for the Services in the twelve (12) months before the event that gave rise to the claim. These limitations do not apply in cases of willful misconduct or gross negligence, and do not restrict the rights of consumers under the Código de Defesa do Consumidor.

10. Suspension and termination

You may close your account at any time. We may suspend or terminate access to the Services in case of breach of these Terms, misuse that threatens the security or operation of the Services, or when required by law or court order. After termination, data is deleted in accordance with Section 4, except where retention is required by law.

11. Changes to these Terms

We may update these Terms. Material changes will be communicated in advance on the Site or by email to registered users, and the “Last revised” date above will be updated. If you do not agree with the changes, you may close your account before they take effect; continued use of the Services after the effective date means you accept the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the district of Florianópolis, State of Santa Catarina, Brazil, have jurisdiction over any dispute arising from these Terms, without prejudice to the right of consumers to file claims in the courts of their own domicile, under article 101, I, of the Código de Defesa do Consumidor.

13. General provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Failure to enforce any provision is not a waiver of it. You may not assign your rights under these Terms without our prior written consent. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Easy Email Verification regarding the Services.
